Official Raffle Contest Rules

By participating, you agree that:

1. These Official Contest Rules may not be waived, modified, or supplemented except by New Mexico Foundation for Education & Research (NMOCF).
2. The raffle drawing shall be held at the New Mexico Regional Common Ground Alliance (NMRCGA) second annual conference luncheon to be held on May 4, 2007 at the Albuquerque Convention Center, Albuquerque, NM. 
3. Each ticket will be entered separately into the drawing. Each ticket is a separate and equal chance to win the Honda ATV.
4. Winner has 10 days to take delivery of the Honda ATV from NMOCF or forfeits all claims thereto.
5. Winner notification will be made by telephone or mail.
6. Successive alternate backup winners will be drawn and held by NMOCF Judges, but not announced in case the first winner does not take delivery of the Honda ATV in 10 days or is otherwise deemed ineligible by the Judges.
7. Participant must be at least 18 years old. Winner may be required to sign an affidavit of eligibility at the discretion of NMOCF.
8. The winner shall be responsible for any and all federal, state and local income or excise taxes, registration, title, transfer fees, license duties, insurance and all expenses in claiming, registering and using the Honda ATV. This may include sales taxes and property taxes. NMOCF has no liability with regard to taxes and fees of any kind for the vehicle.
9. Winner agrees to accept the Honda ATV “as is and where is” and NMOCF does not warrant or imply any warranty of any sort with regard to the condition, performance or use of the Honda ATV by the winner.  Winner is responsible for any modifications required by state or federal laws that may be required in order for winner to use the vehicle lawfully.
10. In the event the Honda ATV is lost, damaged, destroyed, or otherwise not available, NMOCF’s liability shall be limited to refund of ticket price to participants. NMOCF’s liability for any other claim is limited to refund of ticket price.
11. Winner agrees to the use of his/her name, address, photograph or videotape likeness and statements for publicity purposes by NMOCF, or the NMRCGA and agrees to sign a publicity release without any further compensation.
12. NMOCF reserves the right to cancel this contest at any time, in which event its liability is limited to refund of ticket price to participants. Model year and vehicle options advertised are based on availability.
13. Ticket sales to the Judge’s and NMOCF’s board members and their immediate families are prohibited. Immediate family includes spouse and children.
14. All proceeds benefit the NMOCF’s 811 Implementation Fund.  NMOCF is a 501 C3 charitable corporation registered with the Public Regulation Commission’s Corporation Bureau, Certificate of Incorporation Number 2338515.
15. Winner and all other participants agree that the Judges have sole authority in making any decision in any matter regarding the actual drawing procedures or eligibility of winner and the Judge’s decision is final.
16. Cooney Watson and Associates shall provide three persons to be Judges for the raffle and the fulfillment of these rules.
